1 : The mooring fee covers the right to moor only. Ex. Gratia facilities with the mooring include
water supply and toilet waste disposal in the appropriate tank. No solids may be tipped with the
sewage waste, dustbins are provided for rubbish and litter. No litter or waste or sewage may,
under any circumstances, be emptied into the river, mooring basin or on the land anywhere other
than in the appropriate containers. Nothing in the licence shall entitle the owner to the exclusive
use of a particular berth.
2 : Cars may only be parked in the designated area.
3 : Radios, speakers, musical instruments and any other noises are not permitted at such
volumes as to be heard in other boats. Generators may not be used between hours of 14:00 to
08:00 at weekends and Bank Holidays.
4 : Speed limits of 6 mph. on land and 4 mph. on water are to be observed at all times.
5 : Pets are permitted, only by the permission of the proprietor.
6 : Boats must be kept clean, tidy and in shipshape condition and hold a current boat safety
certificate. Precautions against fire in boats, which must carry adequate equipment, are essential.
7 : Persons must use river field only.
8 : Boats moored may not be used for business purposes ( hire etc. ), residential purposes, and
illegal purposes or in a manner likely to cause annoyance to other river users.
9 : Moorings may not be transferred or changed as to the Owner of the craft without prior
agreement by the Proprietor of the moorings.
10 : The Proprietor may move a craft at any time as considered desirable by him and at the sole
risk of the Owner.
11 : The Bidford Moorings and fields are private. Only persons having business are permitted
thereon; all other are liable to action for trespass.
12 : I and my assistants accept no responsibility for loss, damage or delay arising from any cause
whatsoever unless such loss, damage or delay was caused by, or resulted from, our negligence or
deliberate act or that of those for whom we are responsible. Subject to that exception, all vessels
and gear are repaired, worked on, moved, stored or otherwise managed and kept at the sole risk of
the Owner. Customers should therefore ensure that all vehicles and/or vessels are adequately
insured against third party risk as they or their crew whilst on or about the premises.
13 : All craft must hold and display a current licence with the Avon Navigation Trust.
14 : Consent of the Proprietor must be obtained for use of any outside labour or contractor.
15 : Change of address and/or telephone must be notified promptly.
16 : All regulations of River, Local and other authority shall be observed.
17 : The agreement is valid only for the period for which payment has been made in advance.
18 : There shall be no creation of landlord and tenant relationship.
19 : The Proprietor may terminate the agreement or hire of moorings, storage space, property or
facilities without giving and reason by 14 days notice in writing and a refund of the craft shall be
made as to a proportion of the advance payment as the management deems fit after deducting
monies due. If a boat is left in the moorings for more than 24 hours without a valid and paid up
licence agreement, an accommodation fee shall be payable at double the current rate and the
Proprietor may dispose of the craft as herein detailed.
20 : Accounts for goods and services not settled on demand will entitle the Proprietor to dispose
of the craft as detailed here within. Overdue accounts will incur interest at 3% per month.
21 : The Proprietor has the liberty from these conditions to dispose of the craft, the Torts
( interference with Goods ) Act 1977, Ch 3 , will be applied.
22 : Any notice shall be deemed delivered by recorded post to address last received by the
Proprietor.
23 : The boat owner and all persons using the craft shall compensate, reimburse and indemnify
the Proprietor or his agents in respect of any damage, injury, breach of conditions or other wrong
to Station, its installations, personnel or stock ashore or in the water, caused or by : the craft and
its use, the boat owner, any person entering the station at the invitation (expressed or implied) of
the boat owner, or any animal permitted or brought by the boat owner.
24 : The boat owner must be covered for insurance for all these contingencies and also for third
party risk. ( Minimum £1,000,000 ). Trailers and outboards should be included on the boat
owner's insurance policy.
25 : The mooring Proprietor may exercise a general lien upon any vessel and /or her gear
and equipment whilst in or upon their premises or afloat at any of their berths until such
time as any money due in respect of the vessel and /or gear whether on account of rental
storage commission or berthing charges, work done or otherwise shall be paid and the
vessel may be moved and secured elsewhere and the Owner charged with all costs thereby
incurred.
26 : Payment of mooring fees and/or entry to the Station implies acceptance of these conditions
and terms.
27 : No Fishing. Except with the Proprietors permission and then only from the owners
boat. This right can be rescinded by the Proprietor for any reason and at any time.
28 : In the event of the sale by the Owner of any vessel moored or stored at these
moorings the Owner shall pay to the mooring Proprietor a commission of 2% of the sale
price realised. No mooring rights can be transferred to the new Owner.
